  33. A. HISTORY OF THE SOFTWARE

  35. Python originated in 1991 at Stichting Mathematisch Centrum (CWI) in
  36. the Netherlands as an outgrowth of a language called ABC.  Its
  37. principal author was Guido van Rossum, although it included smaller
  38. contributions from others at CWI and elsewhere.  The last version of
  39. Python issued by CWI was Python 1.2.  In 1995, Mr. van Rossum
  40. continued his work on Python at the Corporation for National Research
  41. Initiatives (CNRI) in Reston, Virginia where several versions of the
  42. software were generated.  Python 1.6 is the last of the versions
  43. developed at CNRI.

  59. 1. This LICENSE AGREEMENT is between the Corporation for National
  60. Research Initiatives, having an office at 1895 Preston White Drive,
  61. Reston, VA 20191 ("CNRI"), and the Individual or Organization
  62. ("Licensee") accessing and otherwise using Python 1.6 software in
  63. source or binary form and its associated documentation, as released at
  64. the www.python.org Internet site on September 5, 2000 ("Python 1.6").

  66. 2. Subject to the terms and conditions of this License Agreement, CNRI
  67. hereby grants Licensee a nonexclusive, royalty-free, world-wide
  68. license to reproduce, analyze, test, perform and/or display publicly,
  69. prepare derivative works, distribute, and otherwise use Python 1.6
  70. alone or in any derivative version, provided, however, that CNRI's
  71. License Agreement and CNRI's notice of copyright, i.e., "Copyright (c)
  72. 1995-2000 Corporation for National Research Initiatives; All Rights
  73. Reserved" are retained in Python 1.6 alone or in any derivative
  74. version prepared by Licensee.

  76. Alternately, in lieu of CNRI's License Agreement, Licensee may
  77. substitute the following text (omitting the quotes): "Python 1.6 is
  78. made available subject to the terms and conditions in CNRI's License
  79. Agreement.  This Agreement together with Python 1.6 may be located on
  80. the Internet using the following unique, persistent identifier (known
  81. as a handle): 1895.22/1012.  This Agreement may also be obtained from a
  82. proxy server on the Internet using the following URL:
  83. http://hdl.handle.net/1895.22/1012".

  85. 3. In the event Licensee prepares a derivative work that is based on
  86. or incorporates Python 1.6 or any part thereof, and wants to make the
  87. derivative work available to others as provided herein, then Licensee
  88. hereby agrees to include in any such work a brief summary of the
  89. changes made to Python 1.6.

  91. 4. CNRI is making Python 1.6 available to Licensee on an "AS IS"
  92. basis.  CNRI MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR
  93. IMPLIED.  BY WAY OF EXAMPLE, BUT NOT LIMITATION, CNRI MAKES NO AND
  94. DISCLAIMS ANY REPRESENTATION OR WARRANTY OF MERCHANTABILITY OR FITNESS
  95. FOR ANY PARTICULAR PURPOSE OR THAT THE USE OF PYTHON 1.6 WILL NOT
  96. INFRINGE ANY THIRD PARTY RIGHTS.

  100. RESULT OF MODIFYING, DISTRIBUTING, OR OTHERWISE USING PYTHON 1.6, OR
  101. ANY DERIVATIVE THEREOF, EVEN IF ADVISED OF THE POSSIBILITY THEREOF.

  103. 6. This License Agreement will automatically terminate upon a material
  104. breach of its terms and conditions.

  106. 7. This License Agreement shall be governed by and interpreted in all
  107. respects by the law of the State of Virginia, excluding conflict of
  108. law provisions.  Nothing in this License Agreement shall be deemed to
  109. create any relationship of agency, partnership, or joint venture
  110. between CNRI and Licensee.  This License Agreement does not grant
  111. permission to use CNRI trademarks or trade name in a trademark sense
  112. to endorse or promote products or services of Licensee, or any third
  113. party.

  116. installing or otherwise using Python 1.6, Licensee agrees to be bound
  117. by the terms and conditions of this License Agreement.
